The Brunch! Limited Company Voluntary Waiver and Release Agreement
This Voluntary Waiver and Release Agreement ("Release") is made to allow myself to participate in The Brunch! Limited Company and its sponsored events. I recognize that my signature on this Release is a condition of your permitting myself to participate. I agree that you may photograph and/or videotape myself during The Brunch! Limited Company events and that you retain the rights to use these visual images in any manner you wish without compensation to myself. I further agree that you may use and license to others to use my name, voice, likeness, and any biographical facts which may have been provided to you, including advertising and promoting The Brunch! Limited Company events. I certify that I am in suitable physical health, and may participate in strenuous and potentially hazardous physical activities, including soccer, fitness bootcamp and yoga. I certify that I have listed (on the back of this form) any known physical limits to my participation in The Brunch! Limited Company and its sponsored events in the Medical Information section of this registration. Permission is granted for myself to receive emergency medical treatment if needed, and I agree that I shall be responsible for any and all costs of medical coverage and treatment provided not covered by my insurance.
I EXPRESSLY AND UNCONDITIONALLY ASSUME ALL RISKS AND DANGERS KNOWN OR UNKNOWN, FORESEEN OR UNFORESEEN, AND RELATING OR INCIDENTAL TO MY INVOLVEMENT IN THE BRUNCH! LIMITED COMPANY AND SPONSORED EVENTS AND I HEREBY RELEASE AND DISCHARGE THE BRUNCH! LIMITED COMPANY AND ALL THEIR AFFILIATED ENTITIES AND EACH OF THEIR VENUES, OFFICERS, EMPLOYEES, PARTNERS, SHAREHOLDERS, MEMBERS, OWNERS, SPONSORS, CONTRACTORS, VOLUNTEERS, AGENTS, SUCCESSORS AND ASSIGNS ("RELEASEES") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, AND CAUSES OF ACTION FOR PERSONAL INJURY, PROPERTY DAMAGE, AND/OR OTHER LOSS SUFFERED BY MYSELF IN CONNECTION WITH HIS /HER PARTICIPATION IN SUCH THE BRUNCH! LIMITED COMPANY AND SPONSORED EVENTS. I AGREE TO DEFEND AND HOLD THE RELEASEES HARMLESS FROM ANY LOSS OR DAMAGES, INCLUDING ATTORNEYS' FEES AND COSTS, SUSTAINED BY THE RELEASEES, OR ANY ONE OR MORE OF THEM, AS A RESULT OF ANY RESCISSION OF THIS RELEASE OR BREACH OF ITS COVENANTS OR AGREEMENTS CONTAINED Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Pitch 25 ("the Bar"), Down South Cajjun Eats ("the Bar")& The Brunch! ("The Event") have put in place preventative measures to reduce the spread of COVID-19; however, the Bar and The Event cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Bar and The Event could increase your risk and your child(ren)'s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the Bar and The Event and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Bar may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Bar and Event employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)'s attendance at the Bar or participation in Bar and Event programming ("Claims" On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Bar, The Event, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Bar, The Event, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Bar and Event program.
If the participant is under 18, I represent that I am a parent / guardian of the minor named above and I agree that the grant and release contained therein binds me and the minor to all of its terms.
The validity, interpretation, construction and enforcement of this Release shall be governed and controlled by the laws of the State of Texas, without regard to that State's rules with respect to choice of law. Participant hereby certifies that all information provided on ALL forms is true, accurate and complete in all respects.
